We are committed to protecting your personal information and your right to privacy. This Privacy Policy applies to all information collected through our website (such as www.ohioamf.org), and/or any related products, ideas, content, logos, services, sales, marketing, social media platforms or events (we refer to them collectively in this Privacy Policy as the "Services").

1. Privacy Policy

​

When you access/use our Services, you trust us with your personal information. We take your privacy very seriously. In this Privacy Policy, we seek to explain to you in the clearest way possible what information we collect, how we use it and what rights you have in relation to it.

 

Our Services are not directed to nor do we knowingly collect or maintain information from a minor, which we consider to be anyone under 18 years of age. Minors under 13 years of age are not permitted to access/use our Services. By accessing/using our Services, you represent that you are at least 18 or that you are the parent or legal guardian of such a minor over the age of 13 and you consent to such minor’s access/use of our Services. You are responsible for any and all activity conducted by a minor while accessing/using our Services.

 

By accessing/using our Services, you acknowledge that OhioAMF, and any third-party providers we use in order to provide our Services to you, will access/use your information in the United States and any other country where the third-party provider is located. Please be aware that the privacy laws and standards in certain countries, including the rights of authorities to access/use your personal information, may differ from those that apply in the country in which you reside.​

2. Information Collected

When you access/use our Services, we collect any information you enter on our website or provide us in any other way by accessing/using our Services. We automatically collect certain information about your device, including information about your web browser, Internet Protocol (IP) address, time zone, and some of the cookies that are installed on your device. Additionally, as you access/use our Services, we collect information about the individual web pages or products that you view, what websites or search terms referred you to our Services, and information about how you interact with our Services. We refer to this automatically-collected information as “Device Information”. 
 

We collect Device Information using the following technologies: 
 

  • “Cookies” are data files that are placed on your device or computer and often include an anonymous unique identifier. For more information about cookies, and how to disable cookies, visit http://www.allaboutcookies.org

  • “Log files” track actions occurring on the Site, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps. 

  • “Web beacons”, “tags”, and “pixels” are electronic files used to record information about how you browse the Site. 

  • Additionally when you place an order or attempt to place an order accessing/using our Services, we collect certain information from you, including your name, billing address, shipping address, payment information (including credit card numbers), email address, and phone number. We refer to this information as “Order Information”. 

 

When we talk about “Personal Information” in this Privacy Policy, we are talking both about Device Information and Order Information. ​

3. Information Uses, Sharing & Disclosure

Information Uses

​

Our website is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to sell our products and services to you. Your data may be stored through Wix.com’s data storage, databases and the general Wix.com applications. They store your data on secure servers behind a firewall. 

All direct payment gateways offered by Wix.com and used by our company adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

 

We use the Order Information that we collect generally to fulfill any orders placed using our Services (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to:

  • Communicate with you

  • Screen our orders for potential risk or fraud

  • When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.

 

We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Services (for example, by generating analytics about how our users/customers browse and interact with our Services and to assess the success of our marketing and advertising campaigns). 
 

From time-to-time our Services may request information via surveys or contests. Participation in these surveys or contests is strictly voluntary and you may choose whether or not to participate and therefore disclose this information. Information requested may include contact information (such as name and shipping address), and demographic information (e.g. zip code, day of birth – not date of birth). Contact information will be used to notify the winners and award prizes. Survey information will be used for purposes of monitoring or improving the use and satisfaction of our Services.

 

Information Sharing & Disclosure

We may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights. 
 

Create, Update or Terminate Account

Having an account with us is completely voluntary and free. You may place an order/checkout as a guest accessing/using our Services or you may create a free account. Whether you place an order as a guest or create a free account and place an order, you must provide us with a valid email address in order to receive order-related messages. We may also contact you by telephone to provide support or for order-related purposes.

 

If you would at any time like to review or update the information in your account or terminate your account, you can:

  • Log into your account and update your information where you may review/update

  • Contact us using at info@ohioamf.org to terminate.

 

Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, some information may be retained in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our Terms of Service and/or comply with legal requirements. By default, OhioAMF doesn't delete personal information if the customer placed an order in the last 6 months (180 days), in case a chargeback occurs. If a request for deletion is submitted in that time frame, then it will sit pending, and OhioAMF will complete the action after the appropriate time has passed. You do not need to submit another request.

 

When you access/use our Services by logging in with your Facebook or Google account

Our Services offer you the ability to register and login using some third-party social media account details (like your Facebook and Google logins). Where you choose to do this, we will receive certain profile information about you from your social media provider. The profile Information we receive may vary depending on the social media provider concerned, but may include your name, e-mail address and profile picture as well as other information you choose to make public.

 

We will use the information we receive only for the purposes that are described in this Privacy Policy or that are otherwise made clear to you on the Services. Please note that we do not control, and are not responsible for, other uses of your personal information by your third- party social media provider. We recommend that you review their Privacy Policy to understand how they collect, access/use and share your personal information, and how you can set your privacy preferences on their sites and apps.

 

Your Content

Your Content refers to anything (words, phrases, comments, suggestions, feedback, ideas, proposals, plans, graphics, photographs, videos, or other materials, etc.) you may provide to OhioAMF using any form of communication (online, live chat, instant message, social media, email, postal mail, telephone, etc.) or post on any of OhioAMF Services, including our website and all social media platforms. 

 

Responsibility for Your Content

You understand that you are solely responsible for Your Content. You represent that you have all necessary rights to Your Content and that you’re not infringing or violating any third party’s rights by posting it.

 

Permission to Use Your Content

By providing us Your Content, you grant OhioAMF a license to use it to use it to help OhioAMF function and grow. For example, you acknowledge and agree OhioAMF may use Your Content all or in part, in any of our marketing efforts. You agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any of Your Content you provide to us for any purpose without acknowledgement or compensation to you.

 

Rights You Grant OhioAMF

Here’s the legalese version of the last section. By posting Your Content, you grant OhioAMF a non-exclusive, worldwide, royalty-free, irrevocable, sub-licensable, perpetual license to use, publish, display, edit, modify, reproduce, distribute, store, and prepare derivative works of Your Content for any purpose without acknowledgement or compensation to you. We are and shall be under no obligation to maintain any of Your Content in confidence or to respond to any of Your Content. This allows us to provide our Services and to promote OhioAMF or our Services in general, in any formats and through any channels, including across any of our Services, our partners, or third-party website or advertising medium. You agree not to assert any moral rights or rights of publicity against us for using Your Content. You also recognize our legitimate interest in using it, in accordance with the scope of this license, to the extent Your Content contains any personal information. You agree there shall be no recourse against us for any alleged or actual infringement or misappropriation of any proprietary right in Your Content.

 

That sounds like a lot, but it’s necessary for us to keep OhioAMF going. Consider this example: if you post a photo of yourself on our Facebook page or a product review on our website, we have permission to display it to users/customers, and we can resize it so it looks good to a user/customer. We can feature your photo or product review in any part of our Services, including on our website, on any of our social media platforms, in any of our blogs or marketing emails, or even on a billboard to help promote our Services.

 

Inappropriate, False, or Misleading Content

This should be common sense, but there are certain types of content we don’t want posted/used on any of our Services (for legal reasons or otherwise). You agree that you will not post/use Your Content in a manner that is unlawful, abusive, threatening, defamatory, libelous, or in any way violates someone else’s privacy, or is in any way in violation of any part of our Terms of Service or Privacy Policy, and Your Content will not contain any computer virus or other malware that could in any way affect the operation of our any of Services. You also agree to not post/use Your Content in a false, misleading or deceptive manner. You agree to not pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any of Your Content. You are solely responsible for Your Content and the way in which you post/use Your Content. We take no responsibility and assume no liability for any comments posted by you or any third-party. We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion is in the best interest of OhioAMF.

 

Third Parties

Third-party plug-ins may also collect information about your access/use of our Services. For example, when you load a page on our Services that has a social plug-in from a third-party site or service, such as a “Like” or “Share” button, you are also loading content from that third-party site. That site may request cookies directly from your browser. These interactions are subject to the Privacy Policy of the third-party site. Please be aware that when you access/use third-party sites or services, their own terms and Privacy Policies will govern your access/use of those sites or services.

 

For the purposes of European law, third-party providers are independent controllers of data, which means that they are responsible for providing and complying with their own policies relating to any personal information they obtain in connection with your access/use of our Services.

 

Certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies with respect to the information we are required to provide to them for your order-related transactions. For these providers, we recommend that you read their privacy policies so you can understand the way your personal information will be handled by these providers.  

 

Certain third-party providers may be located in or have facilities that are located in a different jurisdiction than either you or us. So, if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

 

Once you leave our website or are redirected to a third-party website or application (e.g. PayPal), you are no longer governed by this Privacy Policy or our Terms of Service. When you click on links while accessing/using our Services, they may direct you away from our site. We want to be as open and transparent with our users/customers as possible, so below is a list of third-party providers we use and a link to their respective Privacy Policy:

4. Messages from OhioAMF

 

We take steps to limit the promotional content we send you to a reasonable and proportionate level, and to send you information which we believe may be of interest or relevance to you, based on your information. You can opt out of receiving marketing email communications from us at any time by following the instructions provided in those communications. You can unsubscribe from our marketing lists (email and/or SMS – text messaging) at any time by clicking on the unsubscribe link in the emails or sending a text message reply “STOP” to any of our text messages. Or you may contact us directly at info@ohioamf.org. You will then be removed from the marketing lists – however, we will still need to send you service-related emails that are necessary for the administration and use of your account and any orders you place. To close your account contact us via our email.​

5. Security

​

The security of your personal information is important to us. We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and after it is received, for example encryption is used for certain information (such as credit card numbers) using TLS (transport layer security). We also use encryption via Secure Socket Layer (SSL) technology. We work with payment gateways that offer the highest level of security certification (PCI DSS Level 1). Unfortunately, no method of transmission over the internet or method of electronic storage is 100% secure. Therefore, while we strive to protect your personal information, we can't guarantee its absolute security. You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.

 

Credit card information is always encrypted during transfer over networks.

Your account information is protected by a password. It is important that you protect against unauthorized access/use to your account and information by choosing your password carefully and by keeping your password and computer secure, such as by signing out after accessing/using our Services.​

6. Retention

OhioAMF will retain your information only for as long as is necessary for the purposes set out in this policy, for as long as your account is active (i.e. for the lifetime of your OhioAMF account), or as needed to provide our Services to you. If you no longer want us to use your information to provide our Services to you, you may close your account. We will retain and use your information to the extent necessary to comply with our legal obligations (for example, if we are required to retain your information to comply with applicable tax/revenue laws), resolve disputes, enforce our agreements, and as otherwise described in this policy. As previously stated in this Privacy Policy, we use third-party providers to provide our Services to you. Please be aware that when you access/use third-party sites or services, their own terms and Privacy Policies, will govern your access/use of those sites or services.​

7. Your Rights & Choices

Certain privacy laws around the world, including the European General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA), provide users/customers with rights related to their personal information. Consistent with those laws, OhioAMF gives you the choice of accessing, editing, or removing certain information, as well as choices about how we contact you. You may change or correct your OhioAMF account information by logging into your account or by contacting us directly. You can also request to permanently terminate your account and delete your personal information. While some of these rights apply generally, certain rights apply in limited cases. Please contact us directly at info@ohioamf.org to process any requests outlined below. Please note - we are based in the United States and the information we collect is governed by U.S. law.

 

  • Right to Access & Portability: You can access certain personal information associated with your account by visiting your OhioAMF account. You can request a copy of your personal information by contacting us directly at info@ohioamf.org

  • Right to Correction: You have the right to request that we rectify inaccurate information about you. By visiting your account settings, you can correct and change certain personal information associated with your account.

  • Right to Restrict Processing: In certain cases where we process your information, you may also have the right to restrict or limit the ways in which we use your personal information.

  • Right to Deletion: In certain circumstances, you have the right to request the deletion of your personal information, including terminating your account, except information we are required to retain by law, regulation, or to protect the safety, security, and integrity of OhioAMF.

  • Right to Object: If we process your information based on our legitimate interests as explained above, or in the public interest, you can object to this processing in certain circumstances. In such cases, we will cease processing your information unless we have compelling legitimate grounds to continue processing or where it is needed for legal reasons. Where we use your personal data for direct marketing purposes, you can object using the unsubscribe link in such communications (or in the case of text/SMS communication replying to our message with “STOP”).

  • Right to Withdraw Consent: Where we rely on consent, you can choose to withdraw your consent to our processing of your information using specific features provided to enable you to withdraw consent, like an email unsubscribe link or replying with “STOP” for text/SMS messages. This is without prejudice to your right to generally permanently close your account and delete your personal information.

 

The CCPA provides California residents with the following additional rights:

  • Right to Know: California residents may request disclosure of the specific pieces and/or categories of personal information that the business has collected about them, the categories of sources for that personal information, the business or commercial purposes for collecting the information, the categories of personal information that we have disclosed, and the categories of third parties with which the information was shared.

  • Right to Opt-Out: OhioAMF does not sell user/customer personal information and therefore, it's not necessary for you to opt out of the sale of your personal information.

 

If you would like to manage, change, limit, or delete your personal information, you can do so by logging into your OhioAMF account. Alternatively, you can exercise any of the rights above by contacting us at info@ohioamf.org. Limiting use of, or deleting, your personal information may impact features and uses that rely on that information. However, we will not discriminate against you for exercising any of your rights, including otherwise denying you goods or services, providing you with a different level or quality of services, or charging you different prices or rates for services.

Please note that we may verify your identity before we are able to process any of the requests described in this Privacy Policy, and in our discretion, deny your request if we are unable to verify your identity. As a part of this process, government or other identification may be required. You may designate an authorized agent to make a request on your behalf. In order to designate an authorized agent to make a request on your behalf, you must provide a valid power of attorney, the requester’s valid government issued identification, and the authorized agent’s valid government issued identification, and we may verify the authenticity of the request directly with you.

 

Email & Messages

Cookies

We think it's important for you to understand how cookies and other similar technologies are used as part of our Service. These technologies help OhioAMF function, allow us to understand how you access/use our Services, and to help customize your experience.

In addition to the Rights & Choices described above, the CCPA requires disclosure of the categories of personal information collected over the past 12 months. While this information is provided in greater detail in the "Information Collected” Section above, the categories of personal information that we collect – as described by the CCPA – are:

  • Identifiers, including name, email address, IP address, Geo-location and/or device unique identifier

  • Other individual records such as phone number, billing address, or credit or debit card information. This category includes personal information protected under pre-existing California law (Cal. Civ. Code 1798.80(e) and overlaps with other categories listed here.

  • Demographics – your location and day of birth. We may collect your day of birth if you voluntarily choose to provide it us so we can send you promotion(s).

  • Commercial information, including orders and engagement with the Services.

  • Internet activity, including your interactions with our Services and what led you to our Services.

  • Sensory visual data, such as pictures posted on our Service.

 

The Purposes for Our Collection

Third Party Marketing and Advertising and Your Rights (Opt-Out of “Sale”)

OhioAMF does not sell user/customer personal information and therefore, it's not necessary for you to opt out of the sale of your personal information.

 

To opt-out of receiving interest-based advertising, you can exercise your choice by clicking the unsubscribe link in one of our marketing email campaigns, replying with “STOP” to a text/SMS message or contacting us directly at info@ohioamf.org. To ensure the functionality of our Services and make for the best user/customer experience, we use some third-party providers. Please be aware that when you use third-party providers, their own terms and Privacy Policies will govern your access/use of those sites or services. Do not track 


Note that your browser settings may allow you to automatically transmit a “Do Not Track” signal to websites and online services you visit. There is no consensus among industry participants as to what “Do Not Track” means in this context. Like many websites and online services, OhioAMF currently does not alter its practices when it receives a “Do Not Track” signal from a visitor’s browser.
