Dear Ohio Legislators:

Influenza vaccination is an invasive medical procedure with inherent, significant risks including death. Employers should not have privilege that extends into employees’ bodies and subverts employees’ freedom to make personal medical choices. Mandatory influenza vaccination violates the principles of informed consent, personal liberty, and religious freedom defined in the Geneva Convention, the Ohio and United States Constitutions, the Civil Rights Act, the American Medical Association’s Code of Medical Ethics, the Universal Declaration on Bioethics and Human Rights, and Ohio Revised Code 2317.54 Informed consent to surgical or medical procedures or course of procedures.

Ohio House Bill 193 was introduced in May 2017, had 3 hearings, and was voted out of the House Economic Development, Commerce, and Labor Committee on September 12, 2017. It was reassigned to the Health Committee one week later and has only received one sponsor testimony hearing in February. Since the original worker flu shot rights bill, HB170, was introduced in spring 2015, Ohio workers have had to endure 3 “flu shot” seasons without the right to freely accept or decline influenza vaccination without employment consequences. Some workers have been fired. Some have been reassigned jobs. Some have lost merit pay and promotions. Some have left medical careers they loved. Some have gotten sick or experienced short and long term injuries. And at least one died because of this overreaching policy!

Therefore, as a citizen of Ohio, I respectfully request that the Health Committee provide immediate hearings on House Bill 193. This bill would prohibit employers from firing current employees or not hiring prospective employees who decline influenza vaccines. This bill will provide all Ohio citizens the right to medical informed consent, a basic tenet of ethical medical practice. On behalf of all Ohio citizens, I thank you for your support.

HB 193 is a proposed legislative bill to protect Ohio employees from employers. Specifically, the bill prevents employers from terminating, discriminating against, or refusing to hire any person who declines the flu shot for any reason. Reasons can be medical, religious, or philosophical.

Long Title: To enact section 4113.73 of the Revised Code to prohibit an employer from taking an adverse employment action against a person who has not been or will not be vaccinated against influenza.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

Section 1. That section 4113.73 of the Revised Code be enacted to read as follows:

Sec. 4113.73. (A) As used in this section, “employer” has the same meaning as in section 4113.51 of the Revised Code.

(B) No employer shall discharge without just cause, refuse to hire, or otherwise discriminate against any person with respect to hire, tenure, terms, conditions, or privileges of employment, or any matter directly or indirectly related to employment, on the basis that the person has not been or will not be vaccinated against influenza for any reason, including medical, religious, or philosophical.

 

Latest Update on Ohio HB193

Speaker Rosenberger acted against the informed consent rights of the Ohio worker and referred House Bill 193 to another committee for further discussion, the Ohio House Health Committee. Essentially, he told supporters that nearly 2.5 years isn’t enough consideration to uphold their right to say NO to flu shot. He sided with his industry sponsors, ignoring the fact that this issue has to do with an employee’s right to informed consent.

The Health Committee is chaired by Representative Huffman, a physician from Tipp City. We take major issue with this because, as you can see from this graph from FollowTheMoney.org, Rep. Huffman is heavily sponsored by the health industry. Until recently, according to his own bio, Rep. Huffman served on the Board of Directors for Premier Physician Services. We believe this is a conflict of interest. Can Ohio workers count on Huffman to hear testimony and take a vote on HB 193, considering he has so many affiliations with some hospitals and the Ohio Hospital Association is opposing this bill?

We need to focus on the Health Committee, as well as continuing to express frustration with Speaker Rosenberger for stalling this bill, which has had plenty of time and opportunity for the opposition to get its collective act together!

We will not get this bill passed without your help. It is a fact. You have to act now because this is not where the issue will end. It will not stop with a flu shot for workers. This requirement has already infiltrated down to the level of contractors working in hospitals who have zero patient interaction!

Some ideas for getting this done:

1. Get your testimony ready! We have to plan as though they will conduct regular hearings, and we have to FLOOD the committee with testimony when that happens. Your testimony is your statement of support for HB 193 and why. It can be your own story about a reaction, injury, being fired or threatened, doctor bullying, etc.

2. Make one or two calls/emails/etc. per day until you’ve hit the whole list, and then repeat.

3. Letters work even better. Emails may be ignored or seem less important, but letters have to be opened. More work for office staff.

4. Email one study/report/article to the entire committee each day showing flu shot risks and failures and make a simple comment. End with a line about supporting HB 193.

5. Don’t neglect your own legislators, even if your representative isn’t on the Health Committee! Let them know how you feel about the issue. Arrange a meeting with your own representative and senator, and an OAMF member can attend to help if needed. Find them here:
